Why should I use an attorney to create my will and trust?

I get this question a lot, or variations of it: there are so many online services that can do wills and trusts, why should someone use an attorney?

Because we know more than computers do. We know to ask you questions that you don’t know to ask or even think about. We know about how to draft things that are necessary and what to leave out because it’s not necessary. We understand that actual humans are going to be administering an estate plan when someone is incapacitated or dies — so we better make it easy to understand and CLEAR.

This isn’t easy to think about. There are lots of moving parts in every family. There are details that are important for an attorney to know because we’re dealing with humans. We’re dealing with emotions. It’s not enough to just have a computer decide what’s best for your family!

We answer your questions. We are here after everything is signed. We are here to remind you to get your bank account into the trust. (REMINDER TO EXISTING CLIENTS: Go get that bank account in your trust!)

With 95% of my clients, there’s a point when the client says “oh! I never though of that!” And that’s the point.
